EDOs of Australia submission to Senate Inquiry into the Water Amendment (Review Implementation and Other Measures) Bill 2015

A submission to assist the Senate Standing Committees on Rural and Regional Affairs and Transport with its inquiry into the Water Amendment (Review Implementation and Other Measures) Bill 2015. Our submission addresses:

  1. Commonwealth Environmental Water Holder (CEWH): expanding functions to include ‘environmental activities’ and reporting requirements
  2. Review requirements for the Basin Plan
  3. Statutory review of the Water Act
  4. Accreditation of water resource plans
  5. Indigenous matters

The Bill essentially seeks to implement the recommendations outlined in the Report of the Independent Review of the Water Act 2007 (Cth). EDO NSW has written a briefing note outlining some of the key changes proposed in the Bill.

EDOs of Australia firmly support the 'water trigger'. However, we believe that it should be broadened to apply to all large mines that excavate beneath the water table and to all large unconventional gas projects, including water intensive shale gas.

Furthermore, having analysed the operation of the ‘water trigger’ over the last two years, we are now in a position to propose further amendments that would improve the trigger’s capacity to protect water resources. Specifically, the Act should be amended so that:

  • the Minister ‘must not act inconsistently’ with the IESC’s advice when determining a project; 
  • conditions of consent are required to reflect the IESC’s advice; 
  • the Minister must not approve a project until the developer has adequately addressed any concerns raised by the IESC in their report.

EDO NSW submission on the Commonwealth On-Farm Further Irrigation Efficiency Program (COFFIE Program)

Our submission sought clarification regarding two important legal issues:

  • How the COFFIE program will deliver the ‘enhanced environmental outcomes’ for the Coorong, Lower Lakes and Murray Mouth required under the Water Act
  • The nature of the water licences acquired through the COFFIE Program, and whether these licences would be able to deliver 'enhanced environmental outcomes.’

A submission responding to the Senate Select Committee Inquiry into the social, economic and environmental impacts of the Murray-Darling Basin Plan.

Our submission focuses on ensuring that the Basin Plan is implemented on time and in full, and on the importance of delivering the 450 gigalitres of extra water intended to bring about 'enhanced environmental outcomes' in the Ramsar-listed Coorong, Lower Lakes and Murray Mouth region of South Australia.

The submission also discusses the importance of basing all decisions that relate to the Basin Plan on best-available science and socio-economic analysis, and includes recommendations on developing the evidence base.

Submission on the Review of Water Sharing Plan for the Hunter Regulated River Water Source

A brief submission which recommends that the Water Sharing Plan maintain or improve environmental outcomes (particularly in relation to Ramsar wetlands), that dry condition flow targets be amended, and that all water used during uncontrolled flow periods be debited from water accounts.

EDOs of Australia submission on the threat of marine plastic pollution in Australia and Australian waters

In this submission EDOs of Australia calls for:

  • additional regulatory measures to reduce key sources of marine plastic pollution, based on best available evidence (e.g. further implementation of container deposit schemes and extending bans on single-use plastic bags);
  • better resourcing and implementation for pollution offences and infrastructure (internalising pollution costs through a polluter pays approach);
  • timely cooperation between state and federal governments, raising standards to a ‘highest common denominator’ approach to reducing plastic pollution (without delaying effective state efforts like the schemes mentioned above); and
  • reviewing the adequacy of oversight of fishing gear and garbage disposal at sea, and considering Australia’s capacity-building role on marine plastic pollution in the Asia-Pacific region.

The NSW Government is proposing a new whole-of-government approach to mining applications through an Integrated Mining Policy. The Government called for public submissions in two stages from May to September 2015. EDO NSW made key submissions at both stages of the consultation.

Submission to Natural Resources Commission and Department of Primary Industries – Water on the 10 yearly review of water sharing plans

In our submission, we argue that water sharing plans should be assessed by the Natural Resources Commission against clear criteria including: the Water Management Act 2000 ; Basin Plan (where relevant); ecologically sustainable development; best available science; intergovernmental agreements, including Intergovernmental Agreement on a National Water Initiative; and whether or not the yield is sustainable.

The Water Amendment (Review Implementation and Other Measures) Bill 2015 (Bill) essentially seeks to implement the recommendations outlined in the Report of the Independent Review of the Water Act 2007 (Cth).  This briefing note outlines some of the key changes proposed in the Bill.

The Bill was referred to the Senate Standing Committees on Rural and Regional Affairs and Transport (Committee). The Committee conducted an inquiry into the Bill, and called for public submissions by 25 February 2016.
